Linked Work: one-year extension, breath of fresh air for workers 'rights
E' shifted to December 31, 2011 the deadline for submission appeals of workers with temporary contracts expired. This year, therefore, will not apply the rule of the so-called Connected job set for 23 January, the new time limits the appeal of the dismissal was unlawful.
The extension came after an amendment of the Democratic Party 9 February, welcomed the decree 'Milleproroghe'. Satisfied that the CGIL has opposed the law from the beginning and tried to set up an information campaign to publicize the issue to workers. Rosita Galdiero, the CGIL Filcams know, and the provincial secretary Antonio Aprea, explained to the new notebook stressing, however, as the road ahead is still long, especially on issues such as apprenticeships, led to 15 years, the reconciliation arbitration.
rebuild the question. 183/2010 The law, passed by Parliament 19 October 2010 and entered into force November 24, established a new regime of appeal of the contract term. Before it was not a limit of time, was in force only the obligation to assert their rights with a written document within 60 days of expiration. Article 32 also included the so-called 'retroactive'. It was therefore apply to contracts expired at the time of entry into force of the law. As said now is the time, but was extended to the whole 2011.
"This is a first small goal reached - said Galdiero -. Workers with temporary contracts administration, project, temporary, see open another window of opportunity. This achievement comes out of a series of mobilizations fielded by the CGIL, immediately contrary to the college job, throughout the national territory. We need to reach, however, many other goals. "
Meanwhile, the Chamber of Labour of Benevento has collected about 900 applications for appeal of the ruling. "The government and companies - has added the union - came as thousands of appeals and, in order to decide which path to follow, have decided to stay for a while 'the issue, even taking into account that on 28 January, the Court Supreme Constitutional Court has referred to some of the rules related packages in the job. There are, in fact, serious questions of constitutionality. Perhaps then there will be a decision to that effect but, given the long time scales of justice, we continue to mobilize and be on alert. Next year, in fact, we do not know what will happen. "
"There are thousands of workers - added Aprea - have become so specialized in their areas to replace them would be a tragedy. The same government, with parliamentary opposition and the CGIL, seems to have understood the problem. Hence the decision to move the deadline. "
The Secretary has therefore appealed to employees to return at the headquarters of the union for more information on what to do: "It 's an intricate situation and should be dealt with categories of workers. The Government, moreover, has fielded numerous cuts and jobs, especially in our region is highly at risk with thousands of people in precarious conditions. " If
a small victory there was still many, then, are the contents of the law opposed by the union. First, the ability to play, just 15 years, apprenticeship in a company with 400 hours of training. In this way, is lowered by one year the roof of compulsory education. The roof has been the subject of various legislative changes that continued. The latest in 2007 when it was determined that the education given should be given for at least ten years, with the clarification that "the age for access to employment was raised from fifteen to sixteen years." The law was expected that young people graduating from lower secondary school, could enroll in vocational training courses of the Regions. The 2008 summer maneuver again intervened by extending the scope of possible training courses which fulfill the obligation of education to the whole vocational training, industrial experts from the school to be a hairdresser. Today, the Connected job, however, allows a young company entering or leaving the classroom for these sessions.
Then there are the rules discussed on reconciliation e l’arbitrato.
